ERRORS, INACCURACIES AND OMISSIONS

Occasionally, there may be information on our sites that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct or update any such information without prior notice.

Our website is intended for information purposes only, and purchases are not available online. If, due to a technical error or third-party platform issue, an online order is mistakenly accepted through our site, Kyureto reserves the right to cancel such order and issue a full refund. The final and binding price and purchase terms are always those displayed at the kiosk or vending machine at the time of purchase.

 

LIMITATION OF OUR LIABILITY

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our sites or any content on it, whether express or implied. 

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our sites; or

  • use of or reliance on any content displayed on our sites. 

  • If you are a business user, please note that in particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;

  • business interruption;

  • loss of anticipated savings;

  • loss of business opportunity, goodwill or reputation; or

  • any indirect or consequential loss or damage.

If you are a consumer user, please note that we only provide our sites for domestic and private use. You agree not to use our sites for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our sites or to your downloading of any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked on our sites. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

 

VIRUSES

We do not guarantee that our sites will be secure or free from bugs or viruses.

We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

APPLICABLE LAW

If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. 

However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

PART B – TERMS OF KIOSK PURCHASE

These terms apply to all purchases made at Kyureto kiosks and vending machines (‘kiosks’). 

By purchasing a product from a kiosk, you agree to be bound by these Terms of Kiosk Purchases. 

References to ‘kiosk’ or ‘machine’ in these Terms mean the physical vending machine operated by Kyureto from which products are dispensed.

Please note that our website is for information purposes only; all purchases are made directly through kiosks.

 

PRICES AND BILLING

All prices, discounts, and promotions are subject to change without notice. 

QR codes displayed on or near our kiosks link to product or brand information only. They do not constitute an online ordering service. All purchases must be made directly at the kiosk.

Prices shown on our website are indicative only and may differ from kiosk prices. Any discrepancies between the website and kiosk will be resolved in favour of the kiosk price.

The final and accurate price of any product is the one displayed at the kiosk or vending machine at the time of purchase. 

By making a purchase at one of our kiosks, you agree to provide accurate and complete payment information. You represent and warrant that 

 

  • the payment method you use is valid and authorised, 

  • all charges incurred will be honoured by your payment provider, and 

  • you will pay all charges incurred at the kiosk price, including applicable taxes.

 

A payment confirmation will be provided by the kiosk at the time of purchase and displayed on-screen.  

Receipts are available digitally via QR codes. Your bank or card statement also serves as proof of purchase.

RETURNS AND REFUNDS

Products purchased through our kiosks are subject to your statutory rights under UK consumer law. 

If a product is faulty or a kiosk malfunctions and fails to dispense correctly, please contact us at elo@kyureto.com with details of your transaction. 

Refunds will only be provided in accordance with applicable law and our refund policy.

PRODUCT AVAILABILITY AND MACHINE MALFUNCTIONS

All products are subject to availability. We make every effort to ensure kiosks are stocked and operating correctly. In the event of a malfunction or unavailability, Kyureto is not liable for loss or inconvenience, but will, where applicable, offer a refund or replacement in line with our refund policy.

 

PAYMENT METHODS

Our kiosks accept payment by debit/credit card and contactless payment methods. Transactions are processed immediately at the kiosk at the time of purchase.
